Industries which are exempted from the requirements of Industrial permission under THE INDUSTRIES (DEVELOPMENT AND REGULATION) ACT I (D&R),1951 are required to file information related to their setting-up industries is called as IEM (Industrial Entrepreneur Memorandum).
After submission of the information, a confirmation receipt is given by the Department known as ‘ IEM Acknowledgement.’
The IEM Acknowledgement which is issued online on prima facie evidence of not attracting the provisions of license. Therefore, cannot be construed as a clearance or approval to carry on an industrial activity contemplated in the IEM unless the provisions of Regulations / Notifications etc. issued from time to time by the Central or State Governments or any specific ways or Stay Orders issued by the Court / Competent authority relevant to such an activity, are also fully complied with, or in no way contravened, as the case may be. This is filed online application by filing details as per ‘IEM – Part A’ through G2B Portal.
All industries need to file IEM?
All industrial which are exempted from the requirements of Industrial permission under I (D&R) Act, 1951 and having Plant and Machinery Investment more than or equal to 50 Crore Rupees or Turnover more than or equal to 250 Crore Rupees, including Existing Units, New Units may file IEM.
Acknowledgement Receipt will be generated after submission of ‘IEM – Part A’?
All the Online applications which are submitted are verified by the concerned officers in department for verification related to ‘Incorporation Certificate, MoA & AoA’, ‘Master Data’, ‘PAN’ and ‘Codes related to NIC & Administrative Ministry/Department etc. Once the above information is verified and found correct data, department will issue ‘IEM – Part A (Acknowledgement)’ to the applicant.
What is ‘IEM – Part B’?
Industries who had filed the ‘IEM – Part A’ are required to inform the Commercial Production Date and also need to submit the online application to the department with the information as prescribed format of ‘IEM – Part B’ along-with a copy IEM – Part A (Ack.) on the portal. Like ‘IEM – Part A’ , the Department will issue Acknowledgement for ‘IEM – Part B’ to the applicant.
Can IEM’s be modified / Amended?
No Changes are allowed to any IEM’s which are submitted before 30th June, 1998 except for the clerical errors. Later, it has been decided that lEM’s submitted in the new form made effective from 1st July, 1998 and informed through Press Release Note No.4 (1998 Series) dtd. 15-06-1998, can be applied for amendments / modifications as per the request of the applicants. The amendments would be subject to the terms and conditions spelt out in Press Release Note No. 17(1997 Series) dtd. 27-11-1997 with reference to the statutes / regulations / notifications issued from time to time by the Central and State Governments.
